TERMS AND CONDITIONS FOR CAKE ORDERS

Please take the time to read through these terms and conditions, as they form the basis of the contract for your purchase.

The Seller

Julie’s Cake in a Box is owned and run by Julie Rogerson.

Payment

Deposit & payment

For wedding cake orders a £50 deposit is required at time of ordering. Dates will not be held without payment of deposit. This is a non-refundable and non-transferable fee to secure the date you require. Final payment for wedding cakes is due no later than FOUR WEEKS before the wedding date. If the final payment is not received a reminder may be sent, if no further payment is made we will consider the order cancelled and the deposit lost.

For celebration cakes a minimum deposit of 30% is required at time of ordering (unless otherwise agreed). Dates will not be held without payment of deposit. All deposits are non-refundable. For celebration cakes final payment will be due ONE WEEK before the delivery / collection date, unless otherwise agreed.

Deposit and balance payment can be made via bank transfer, Paypal or cash.

Deposits for hire of equipment

All hired items (eg cake stands) will require a deposit to be paid at time of ordering. This deposit will be returned if the hired item is returned to us in the same condition within 7 days of the event. Damaged or missing items will incur loss of deposit, which will be used by us to replace the item.

Delivery/Collection

For deliveries

Delivery charges (if applicable) will be discussed at time of ordering.

Whenever possible, the cake will be set up in it’s final location for wedding cakes. If this is not possible, the cake will be left with a member of staff from the venue. Julie’s Cake in a Box cannot be held responsible for any damage to the cake after delivery.

For collections

Julie’s Cake in a Box cannot take any responsibility for damage to cakes when collected and transported by their customers.

DO NOT place the cake on a seat (or a passengers knee) in the car, as this can damage the cake. The cake should be transported on a flat surface – either in the boot or the foot well of the car on a non-slip mat (if you do not have one, please ask). Extra care should be taken when driving as some elements may be delicate. Also, please be aware of the internal temperature of your car, particularly on hot days – use air conditioning if available and do not leave the cake in your car.

Storage

All cakes should be stored on a flat surface at room temperature in the box provided. Do not refrigerate. They should be kept out of direct sunlight.

Sponge cakes should be consumed within 48 hours of collection/delivery.

Allergy information

Julie’s Cake in a Box DOES NOT have an allergy-free kitchen.

We CANNOT GUARANTEE that any of our products are free from ingredients that may affect those with food allergies. We recognise the seriousness of food allergies and ask that you inform us of any food allergies that you or your party may have when ordering.  We reserve the right to decline any orders for clients with serious food allergies and will not assume any liability for adverse reactions to our products.

The following ingredients are present and used in our kitchen, which may potentially result in cross contamination:

•                Milk and other dairy products

•                Eggs

•                Nuts

•                Wheat and gluten

Please note that some food colourings may have an effect on behaviour in children.

Non edible decorations

Most cakes contain small proportions of inedible items e.g. Support dowels in tiered cakes, ribbon, supports/armatures in models, wires in sugar flowers, Swarovski crystals, flower picks & flower tape etc.

You will be informed of any non-edible elements in your cake, and it is your responsibility to ensure these are removed before serving.

Cancellation and refunds

Cancellation by the customer: If you cancel your order, your deposit is non-refundable and non-transferable, payment is required for any and all expenses already incurred on behalf of the finished product.

For wedding cakes if you cancel within 3 months of your wedding date 50% of the balance payment will be invoiced. This is to cover monies lost, as Julie’s Cake in a Box will have kept your date for you and it is very unlikely the date could be re-filled at such short notice. If you cancel your wedding cake within 1 month of your wedding date, full payment will be retained.

For celebration cakes if you cancel within 4 weeks of your event 50% of the full payment will be invoiced. If you cancel within 7 days of your event full payment will be retained.

Cancellation by Julie’s Cake in a Box – In the event of exceptional circumstances, such as serious illness, we will give as much notice as possible if we are unable to fulfil your order. We will endeavour to find someone else who can produce your order and will refund you any monies already paid.

Postponements: In the event that you wish to postpone your wedding please let us know as soon as possible. Your previous booking will be considered cancelled, subject to the cancellation policy above and a new booking will be placed for the new date. New bookings will be subject to any price increases since the original booking was made.

Force Majeure

Julie’s Cake in a Box shall not be liable or responsible for any failure to perform, or delay in performance of, any obligations under these Terms and Conditions, that is caused by events outside of our reasonable control (ie ‘Force Majeure Event’).

A Force Majeure Event includes any act, event, non-occurence, omission or accident beyond our reasonable control, and you agree that the following shall all be Force Majeure Events:

Extreme weather conditions, including, but not limited to, winds, snow, rain, storm, fire or floods, or any natural disaster whatever.

Impossibility or difficulties with the use of any relevant means of public or private transport for any reason

Cancellation by any third party of related services

Impossibility or difficulties with the use of public or private telecommunications networks, including the internet, for any access of any part of the Website

Inability to receive materials ordered, due to a third party supplier failure, which was beyond our control

Civil unrest, riots, strikes, transport delays, global pandemics and anything connected with such events

The failure of any computer or telecommunications system or hardware or software of any description

The failure of the Website, affiliate interface or supported or connected technology

Our obligations under these Terms and Conditions will be suspended for the period that the Force Majeure Event continues, and we will have an extension of time to perform these obligations for the duration of that period.

In all cases, we will take reasonable steps to bring the Force Majeure Event to a close, or to find a reasonable solution, by which our obligations under these Terms and Conditions can be performed, despite the Force Majeure Event. If this is not possible, we will discuss with you how best to address this.

Privacy Policy

Any personal data provided by yourself, either as part of the ordering process, or by joining our mailing list, will be stored securely and not shared or sold to any other third parties.

Copyright and images

All designs produced by Julie’s Cake in a Box are copywrighted to us and cannot be used without our permission.

Photographs may be taken of your cake and published on our website and/or social media pages.

Liability

Any liability will be limited to the cost of your cake.

No liability will be accepted for any losses beyond this cost.

Customer Satisfaction Guarantee

At Julie’s Cake in a Box, we pride ourselves on making fabulous cakes!

So, if you are not happy with your cake when you come to collect it, and choose not to take the cake, you will be entitled to a 100% refund!

Refund policy

Refunds for cakes are expressly at the discretion of Julie’s Cake in a Box.

Refunds will not be given for customers that have simply changed their mind or if the cake has been damaged out of our care.

If you have any complaints about the quality of the cake when cut, please inform us in writing, and return within 24 hours of collection of the cake.

For wedding cakes, this returns period is extended to 48 hours from delivery of the cake to your venue.

This enables us to fairly assess your complaint and the quality of the cake.

The cake must have been stored at the correct temperature and in the box supplied, out of the sun and away from damp conditions or heat. If you are complaining about the quality of the cut cake, you must return at least 75% of the uneaten product within 24 hours (48 hours for wedding cakes).

If the cake has been consumed in full, or is not returned to us for inspection, as detailed in these Terms and Conditions, then no refund can be given.
